Terms of Service

"Platform" means the HOLO website, applications, and supporting services.

"Card" means a real, physical trading card we hold in our vault on your behalf or that we transfer ownership of through Platform mechanics.

"Pack" means a digital pack you purchase from HOLO that grants the right to draw one or more physical Cards from a fixed prize pool.

"HOLO Singles" means a direct sale of an individual physical Card by HOLO to a buyer.

"Marketplace" means the peer-to-peer secondary market through which verified members buy and sell Cards from one another under HOLO's escrow.

"Seller Balance" means the internal credit balance maintained for each user, denominated in Thai Baht (THB), as described in Section 11.

"KYC" means know-your-customer identity verification, as described in Section 5.

You must be at least 18 years old and legally able to enter into a binding contract under the laws of your jurisdiction to use HOLO. If you are using HOLO on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

HOLO operates primarily for residents of Thailand. We may, at our sole discretion, restrict or refuse service to users in jurisdictions where collectible card trading, gacha-style mechanics, or related payment flows are restricted under applicable law.

To use most features of HOLO you must register an account with a valid email address, choose a unique username, and create a password. You agree to provide accurate, current, and complete information and to keep that information updated.

You are solely responsible for activity that occurs under your account, including for safeguarding your login credentials. Notify us immediately at the contact address in Section 24 if you suspect unauthorised access.

We may suspend, restrict, or terminate accounts that we reasonably believe are inactive for an extended period, are duplicates, have been used in violation of these Terms, or have been compromised.

Browsing, purchasing Packs, opening Packs, and purchasing HOLO Singles do not require KYC. Listing Cards for sale on the Marketplace, withdrawing Seller Balance to a bank account, and certain other features require completion of KYC.

KYC requires you to submit: legal name; residential address; mobile phone number; Thai national ID number (or passport number for non-Thai nationals); a clear photo of your government-issued ID; a selfie holding that ID; and bank account details consistent with your verified identity. We may request additional information at our discretion.

We use the information you provide to satisfy applicable anti-money-laundering, anti-fraud, and consumer-protection obligations. Submission of false, altered, or fraudulent KYC information is grounds for immediate account termination and forfeiture of Seller Balance pending investigation.

Every Card available on HOLO is a real, physical trading card that we hold in a climate-controlled vault in Bangkok, Thailand. When you win or purchase a Card, ownership is transferred to your name in our database and the physical Card is held in your name in our vault.

You may request shipment of any Card titled to you at any time, subject to the shipping fees and rules in Section 14. Until shipment, the Card remains physically with HOLO.

We carry commercial insurance covering Cards held in our vault. In the event of loss or destruction of a Card while in our custody, our maximum liability to you is the most recent published estimated value of the Card on the Platform.

Packs are sold by HOLO directly. Each Pack has a published price, the number of Cards it yields per opening, and a transparent drop-rate table by rarity tier shown on the Pack's store page.

Pack openings are determined server-side using cryptographically secure random number generation. Each opening is recorded in an immutable audit log that we can produce upon request to investigate a specific transaction.

Cards in a Pack's prize pool are real, finite, and removed from the pool the moment they are won. Once the pool is exhausted, the Pack becomes unavailable for purchase. Drop rates apply across the pool — actual outcomes of any individual opening are governed by randomness within the published rates.

Some Packs include a "pity" guarantee that elevates the rarity tier of an opening when a configurable threshold of low-value pulls has been reached. The pity threshold and tier are disclosed on the Pack's page.

Once a Pack is opened, the opening is final. No refunds will be issued based on the rarity of the Cards pulled.

HOLO Singles are individual Cards sold by HOLO directly at a fixed price. Purchase transfers ownership of the specific Card to you immediately upon successful payment.

There is no marketplace fee on HOLO Singles. The price displayed is the price you pay.

Only KYC-verified users may list Cards on the Marketplace. By listing a Card, you represent that you are the rightful owner, that the Card is in your HOLO vault account, and that the description and photographs are accurate.

A platform fee of five percent (5%) of the listing price is deducted from the seller's proceeds at the time the transaction completes. The fee is shown on the listing page and confirmed before a sale completes.

Marketplace transactions are completed only through HOLO's escrow flow (Section 9). Off-platform sales of Cards held in HOLO's vault are not permitted and may result in suspension.

HOLO is not a party to Marketplace transactions; we provide the venue, the escrow, and dispute mediation.

When a buyer purchases a Marketplace listing, the purchase amount is held in escrow. The funds are released to the seller's Seller Balance only after the seller's obligations (typically: reservation of the Card and, where applicable, shipment) are satisfied and the buyer has confirmed receipt (or the buyer-confirmation window has elapsed without a dispute).

Either party may open a dispute through the Platform within the time frames published in our Help Centre. HOLO will review the evidence — including but not limited to message logs, shipment tracking, vault movement records, and photographs — and issue a decision binding on both parties.

Possible dispute outcomes include releasing funds to the seller, refunding the buyer, partial refund, replacement, or referral to local authorities in cases of fraud.

Shipment of Cards from the vault to your address is offered as a paid service. Standard and express options, along with their fees, are shown at checkout.

Shipping fees, carriers, transit times, and tracking are provided as a convenience. While we use commercially reasonable efforts to ship promptly, transit times are estimates and not guarantees.

Risk of loss for a shipped Card passes to you upon delivery. We strongly recommend insured shipping for Cards with significant value. Shipping insurance, where available, is offered at additional cost.

It is your responsibility to keep your shipping address current and to be available at the address to receive deliveries. Re-shipment fees may apply to failed deliveries caused by incorrect or incomplete address information.

Seller Balance is an internal credit balance denominated in Thai Baht (THB), maintained for each user. It is funded by completed Marketplace sales (net of fees), HOLO buy-back transactions, referral bonuses, login-streak rewards, refunds of HOLO-issued orders, and other promotions or adjustments described elsewhere on the Platform.

Seller Balance may be spent on HOLO-issued Packs and HOLO Singles. It MAY NOT be used to pay for peer-to-peer Marketplace listings; those require payment via PromptPay so escrow has a real cash trail for dispute resolution.

Every change to your Seller Balance is recorded in a ledger viewable on your /balance page. If you believe the recorded balance is incorrect, contact us promptly and we will reconcile the ledger against the source events (orders, payouts, withdrawals).

Seller Balance is not a deposit account, is not interest-bearing, and is not transferable between users.

You may request a withdrawal of your Seller Balance to the bank account associated with your KYC record at any time, subject to a minimum withdrawal of THB 200 and the limit that only one withdrawal request may be in flight per user at a time.

On submission, the requested amount is debited from your Seller Balance immediately so it cannot be double-spent on Packs or Singles while we process the payout. Withdrawals are typically processed within two (2) business days. If a request is declined or cancelled before payout, the amount is automatically restored to your Seller Balance with a corresponding ledger entry.

HOLO does not charge a withdrawal fee. Your bank may apply its own fees over which we have no control.

We may decline or delay a withdrawal where we reasonably suspect fraud, where the request appears to violate applicable law, or where the receiving account does not match your KYC record.

You may, at your election, sell a Card you own back to HOLO at the published buyback offer at the time of sale. Buyback proceeds are credited to your Seller Balance.

Buyback eligibility is conditional on the Card being in your HOLO vault account (not in an active listing, escrow, or pending shipment), and on the Card being in the condition recorded on the Platform.

All Pack and Singles prices on the Platform are inclusive of applicable Thai value-added tax (VAT) at the prevailing rate unless explicitly stated otherwise.

The Marketplace platform fee is five percent (5%) of the listing price, deducted from seller proceeds at transaction completion.

You are solely responsible for any income tax, capital gains tax, or other tax obligations arising from your activity on HOLO (including sales of Cards on the Marketplace and withdrawals to your bank). HOLO is not your tax advisor.

You agree not to: (a) circumvent or attempt to circumvent the escrow flow for Marketplace transactions; (b) submit false or misleading KYC information; (c) operate multiple accounts for the purpose of evading restrictions, abusing promotions, or distorting drop rates; (d) attempt to manipulate, reverse-engineer, or interfere with the pack-opening random number generator or the audit log; (e) use the Platform to facilitate money laundering, terrorist financing, or any unlawful activity; (f) post, transmit, or upload content that is unlawful, defamatory, harassing, or infringing of intellectual property rights; (g) probe, scan, or test the vulnerability of the Platform without our prior written consent; or (h) use automated tools, bots, or scripts to interact with the Platform other than through public APIs we may publish.

Violations may result in suspension, termination, forfeiture of Seller Balance pending investigation, return of Cards to their original ownership state, and referral to applicable authorities.

The Platform, including its software, design, graphics, and the HOLO name and marks, is owned by HOLO Collectibles and its licensors and is protected by intellectual property laws.

The trading cards traded on HOLO depict properties owned by third parties (e.g. Pokémon, One Piece, MLB, NBA, NFL, and others). HOLO does not claim any ownership of those properties. We facilitate the trade of physical cards as a secondary market under principles of first-sale exhaustion applicable in the jurisdictions in which we operate.

Any user-submitted content (photos, descriptions, listing notes) you upload remains your property. You grant HOLO a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content for the purpose of operating and promoting the Platform.

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, HOLO disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Estimated values shown on the Platform are informational only and do not constitute a guarantee of future resale value.

To the maximum extent permitted by applicable law, HOLO's total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform is limited to the greater of: (a) the total fees you paid to HOLO in the twelve (12) months preceding the event giving rise to the claim; or (b) the most recent published estimated value of the specific Card(s) at issue.

HOLO is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or wilful misconduct.

You agree to indemnify and hold harmless HOLO, its affiliates, officers, employees, and agents from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of applicable law, or your infringement of the rights of a third party in connection with your use of the Platform.

You may close your account at any time by contacting us. If you have a positive Seller Balance, you may request a withdrawal subject to Section 12 before closure.

We may suspend or terminate your access to the Platform at any time, with or without notice, for breach of these Terms, suspected fraud, regulatory requirement, or where required to protect the safety or integrity of the Platform.

On termination: (a) Cards titled to you remain titled to you and may be shipped or transferred subject to standard rules; (b) Seller Balance held to your credit may be paid out subject to satisfaction of KYC and the rules in Section 12; and (c) provisions of these Terms that by their nature should survive (intellectual property, disclaimers, liability limits, governing law) will survive.

We may amend these Terms from time to time. Material changes will be notified via email or in-app notice at least seven (7) days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the amended Terms.

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved through good-faith discussion shall be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand.

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force.

These Terms, together with our Privacy Policy and any policies referenced from the Platform, constitute the entire agreement between you and HOLO regarding the Platform.
